Russian government has serious plans to create a new authority special for intellectual property regulation. Such authority would be designed only for IP in Russia, like IPO in UK, patent office in USA and other similar authorities in different countries. But the question is the nature of such authority.

Not so long time ago it was adopted a new law on VPN services in Russia. This law obliges VPN services to restrict access to web-sites blocked in Russia. Otherwise the VPN services can be blocked itself in Russia. How this law is implemented in Russia? What has been changed more than three months after adoption of this law? Almost nothing. Roskomnadzor has another instrument to regulate the internet in Russia.

Russian authority, supervising internet, Roskomnadzor calls such practice “excessive blocking of web-site in internet”. Sometimes web-sites of banks and retailers fall under restriction of access. But there is one little detail.

Thanks to amendments to Russian law, it is possible to restrict access even to mirror of web-site, which was blocked in Russia, and sometimes even VPN is powerless to circumvent blocking. RuTracker’s idea is something similar to P2P principle – multiple domains would provide multiple accesses to main web-site.

It means Russian ISP could cut the traffic when they believe it is necessary and justified. Many stakeholders disliked the idea with 5 mln roubles for permission to show movie in Russian cinema. Therefore MinCult proposed something new – 3% of revenue from ticket sales. This 3% could make “additional 1,5 billion roubles” for funding of Russian movies.

Under the current Russian law the access to the web-site can be restricted without court order if the Attorney General or his deputy believes that such web-site disseminates information or content calling to mass disorder, extremist activities, participation in public events, organised in violation of Russian law and if such web-sites is operated by non-governmental organisation, recognised non-grata in Russia.

According to this research more than 25% of popular internet stores don’t comply with current Russian law. Approximately 1000 online store have been analyzed during the research.
